3. Service Plans and Pricing
Our services are offered through various pricing tiers based on qualified leads delivered:
- Starter Plan: $30 per qualified lead
- Professional Plan: $50 per qualified lead
- Enterprise Plan: $75 per qualified lead
Pricing may vary based on industry, target market complexity, and specific campaign requirements. All pricing is subject to change with 30 days' notice.
4. Lead Qualification Criteria
A qualified lead is defined as a prospect who meets the following criteria:
- Has expressed genuine interest in your products or services
- Meets your specified demographic and firmographic requirements
- Has provided accurate contact information
- Has engaged meaningfully with your marketing content
- Fits within your defined ideal customer profile
5. Payment Terms
Payment is due within 30 days of invoice date. We accept major credit cards and bank transfers. Late payments may incur a 1.5% monthly service charge. Services may be suspended for accounts more than 60 days past due.
6. Client Responsibilities
As a client, you agree to:
- Provide accurate information about your target market and ideal customers
- Respond promptly to qualified leads provided by our service
- Maintain professional standards in all lead interactions
- Comply with all applicable laws and regulations in your marketing activities
- Provide feedback on lead quality to help optimize campaigns
7. Service Level Agreement
We strive to deliver qualified leads within agreed-upon timeframes. While we cannot guarantee specific results, we commit to:
- Providing regular campaign performance reports
- Responding to client inquiries within 24 hours during business days
- Continuously optimizing campaigns based on performance data
- Maintaining transparent communication about campaign progress
8. Intellectual Property
All proprietary technology, algorithms, and methodologies used in our lead generation services remain the exclusive property of FernNet. Clients retain ownership of their own data and marketing materials provided to us.
9. Confidentiality
We maintain strict confidentiality regarding all client information, campaign strategies, and business data. We will not share your information with third parties except as necessary to provide our services or as required by law.
10. Data Protection and Privacy
We are committed to protecting your data and the data of your prospects. Our data handling practices are detailed in our Privacy Policy. We comply with applicable data protection regulations including GDPR and CCPA.
11. Limitation of Liability
FernNet's liability is limited to the amount paid for services in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages. Our services are provided "as is" without warranties of any kind.
12. Termination
Either party may terminate services with 30 days' written notice. Upon termination:
- All outstanding invoices become immediately due
- Access to our platform and services will be discontinued
- Client data will be securely deleted within 90 days unless otherwise requested
- Confidentiality obligations continue indefinitely
13. Compliance and Legal Requirements
Clients must ensure their use of our services complies with:
- CAN-SPAM Act and other anti-spam regulations
- TCPA (Telephone Consumer Protection Act) requirements
- GDPR and other data protection laws
- Industry-specific regulations applicable to their business
- Platform-specific terms of service for advertising channels
14. Dispute Resolution
Any disputes arising from these terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in Texas, United States.
15. Force Majeure
Neither party will be liable for delays or failures in performance resulting from circumstances beyond their reasonable control, including natural disasters, government actions, or technical failures of third-party platforms.
16. Modifications to Terms
We reserve the right to modify these terms at any time. Material changes will be communicated with 30 days' notice. Continued use of our services after changes constitutes acceptance of the modified terms.
